1. Agreement to Terms

By creating an account or using the SmartPages platform (“Service”), you agree to be bound by these Terms of Service and all applicable laws.
If you do not agree, you may not access or use the Service.

2. Description of Service

SmartPages is a modular Software-as-a-Service (SaaS) platform operated by Profi Marketing LLC, providing tools to create professional profile pages, shortlinks, and managed domains (“SmartDomains”).
The Service is provided online and may include both free and paid features.

3. Account Registration

You must be at least 18 years old to create an account.
You are responsible for maintaining the confidentiality of your login credentials and all activities under your account.
You agree to provide accurate information and to notify us of any unauthorized use.

4. User-Generated Content

SmartPages enables users to publish their own content, links, and media.
You are solely responsible for all content you create or distribute through SmartPages.
Profi Marketing LLC does not pre-screen or monitor user content but may remove or disable content that violates these Terms or applicable law!

5. Acceptable Use Policy

You agree not to use SmartPages to:

  • violate any law or third-party rights,

  • publish defamatory, hateful, or illegal content,

  • distribute malware or spam,

  • misrepresent your identity or affiliation.

Violation may result in immediate account suspension.

6. Free Trial

New users may start with a 7-day free trial.
No payment is required during the trial period.
If you do not cancel before the trial ends, your subscription will automatically convert to a paid plan (monthly or annual).
Cancellations during the trial incur no charges.

Your 7-day trial period includes your statutory right of withdrawal under EU consumer law.
Once billing begins, the right of withdrawal no longer applies.

7. Subscriptions, Payments, and Renewals

SmartPages offers monthly and annual subscription plans.
Payments are processed securely by our authorized providers:

  • Stripe, Inc. (for EUR and USD transactions)

  • Digistore24 GmbH (for selected EU customers)

Charges are displayed in Euro (EUR) or U.S. Dollars (USD) depending on location.
Subscriptions renew automatically at the end of each billing cycle unless cancelled.
You may cancel at any time; cancellation takes effect at the end of the current paid term.

Payments already made are non-refundable except where required by law.

8. Domain Registrations (SmartDomains)

By ordering a SmartDomain, you authorize Profi Marketing LLC to register a domain name on your behalf with an accredited registrar.
Because domain names are unique and individually registered, they cannot be cancelled or refunded once activated.

Domain registrations are classified as personalized digital services and are excluded from the EU right of withdrawal under Directive 2011/83/EU Art. 16 (a,m).

Each domain is billed annually in advance and renews automatically unless cancelled 14 days before renewal.
If your SmartPages subscription ends, your domain remains active until its paid term expires.

9. Refunds and Withdrawal

SmartPages provides access to personalized digital content and services.
By starting to use SmartPages, you expressly acknowledge and agree that the service begins immediately and that you waive your right of withdrawal under EU Directive 2011/83/EU Art. 16 (a,m).

Refunds are not issued for partially used subscription periods or domain registrations.

10. Privacy and Data Protection

Personal data is processed in accordance with our Privacy Policy, available at:
smartpages.online/privacy

SmartPages complies with the GDPR / DSGVO and uses only verified processors (Cloudflare Inc. and HubSpot Inc.) operating under EU Standard Contractual Clauses.

11. Intellectual Property

All software, design, and trademarks associated with SmartPages remain the property of Profi Marketing LLC.
You may not copy, modify, reverse-engineer, or redistribute any part of the Service without written consent.

12. Termination

You may terminate your account at any time via your dashboard or by contacting compliance@smartpages.online.
Profi Marketing LLC may suspend or terminate accounts that violate these Terms or applicable law.
Upon termination, your access to the Service ends immediately.

13. Disclaimers of Warranty

The Service is provided “as is” and “as available.”
Profi Marketing LLC makes no warranties of uninterrupted operation or error-free functionality.
You use the Service at your own risk.

14. Limitation of Liability

To the maximum extent permitted by law, Profi Marketing LLC shall not be liable for any indirect, incidental, or consequential damages, including lost profits or lost data.
Total liability for any claim shall not exceed the amount you paid in the 12 months preceding the claim.

15. Indemnification

You agree to indemnify and hold harmless Profi Marketing LLC and its affiliates from any claims, damages, or expenses arising from your content or misuse of the Service.

16. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Wyoming, USA, excluding its conflict-of-law rules.
Any disputes shall be resolved before the competent courts of Sheridan County, Wyoming.

17. Changes to the Terms

We may update these Terms from time to time.
The latest version is always available at:

Continued use of the Service after changes constitutes acceptance of the updated Terms.
